These Terms of Service ("Terms") govern your access to and use of the website, content, products, and the private membership community ("The Better Days Crew") offered by Better Days Crew ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to use the Services or join the community. By using the Services, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.
2. Not Professional Advice
The Services, including all content, messages, calls, and community discussions, are provided for general informational and educational purposes only. We are not licensed medical, mental health, legal, or financial professionals. Nothing on the Services constitutes medical, psychological, legal, financial, or other professional advice, and no provider-patient, therapist-client, or attorney-client relationship is created. Always consult a qualified professional for advice specific to your situation.
3. Mandatory Reporting
We are mandatory reporters. Any disclosure of self-harm, intent to harm yourself, intent to harm others, abuse, or neglect of a child or vulnerable adult may be reported to law enforcement, emergency services, or appropriate Florida state authorities, including the Florida Department of Children and Families. By using the Services, you acknowledge and consent to this reporting obligation.
If you are in crisis: Call 911, go to the nearest emergency room, or call or text 988 to reach the Suicide & Crisis Lifeline.
4. Programs, Payment, Refunds & Program Window
- Programs: Better Days Crew offers a 30-day transformation experience in two formats: a 2-day in-person experience combined with a 30-day program ($4,000 USD), and a fully virtual 30-day program ($2,500 USD). Prices are in U.S. dollars and may change for future purchases.
- Payment in full: Payment is due in full prior to any services being rendered. Your spot is not reserved until payment is received.
- Non-refundable and non-transferable: All services and information are non-refundable and non-transferable. This includes situations where you choose not to participate, do not complete the program, are removed for violating these Terms, or are unable to attend.
- Program window — virtual: The virtual 30-day program begins on the date of purchase and runs for thirty (30) consecutive calendar days. It is delivered as one (1) 1-hour Zoom session per week for four (4) weeks, scheduled based on mutual availability. The 30-day window may not be split, paused, or extended.
- Program window — in-person: The 30-day program portion of the in-person experience begins on the date of your in-person meetup and runs for thirty (30) consecutive calendar days. The 30-day window may not be split, paused, or extended.
- In-person scheduling & location: The 2-day in-person experience is hosted in southwest Orlando, Florida, and consists of two (2) 8-hour windows scheduled on weekdays, excluding holidays and special events, based on Dalton's availability. The two in-person days may not be split across non-consecutive scheduling blocks outside of what is mutually agreed at booking.
- Personal expenses (in-person experience):Your investment covers transformation time and information only. You are solely responsible for your own travel, transportation, lodging and accommodations, food and beverages, personal purchases (including clothing, grooming and haircuts, theme park admissions, gas, parking, and any other personal items), and any other expenses incurred during the experience.
- Substance policy: No drugs, alcohol, smoking, or vaping are permitted at any time during the experience. Violation may result in immediate removal from the program with no refund.
- No guarantee of results: Results are not guaranteed or promised. All information shared is based on personal experience and may not apply to your unique situation.
5. Community Guidelines & Conduct
The Better Days Crew exists to be a safe, judgment-free space. You agree not to:
- Threaten, harass, bully, intimidate, or stalk any member or staff;
- Engage in rude, malicious, hateful, discriminatory, or harmful behavior;
- Post content that is sexually explicit, inappropriate, profane, or otherwise objectionable;
- Make romantic or sexual advances toward members or staff;
- Use the community to promote, sell, or solicit goods, services, businesses, political views, or causes without permission;
- Share another member's private content, identity, or contact information without consent;
- Impersonate any person or misrepresent your affiliation;
- Post unlawful, infringing, defamatory, or fraudulent content;
- Disrupt the community, weekly calls, or the experience of other members; or
- Violate any applicable law or these Terms.
Removal: We may suspend or permanently remove your access to the community at any time, in our sole discretion, for any violation of these guidelines or these Terms. Removal does not entitle you to a refund.
6. User-Generated Content
You retain ownership of content you post, but grant us a non-exclusive, royalty-free, worldwide license to host, store, display, and distribute that content within the Services as needed to operate the community. You represent that you have the right to post the content and that it does not violate any third-party rights or applicable law.
7. Intellectual Property
All website content, branding, logos, text, graphics, audio, video, and software (excluding user-generated content) are owned by Better Days Crew or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
8. Third-Party Services
The Services rely on third-party providers (including Stripe for payments and social platforms for messaging). Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR ACHIEVE ANY PARTICULAR OUTCOME. WE DO NOT GUARANTEE ANY SPECIFIC RESULT FROM PARTICIPATION IN THE COMMUNITY.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, IN NO EVENT SHALL BETTER DAYS CREW, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Better Days Crew and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services immediately ceases. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will continue to apply.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. You agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Services shall be the state and federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may modify these Terms from time to time. Changes are effective when posted and reflected by the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.
